Tesla, the electric vehicle company headed by Elon Musk, is facing a lawsuit filed by the nonprofit Environmental Democracy Project. The lawsuit alleges that Tesla has been in ongoing violation of the Clean Air Act at its assembly plant in Fremont, California. According to the environmental group, Tesla has violated the law “hundreds of times since January 2021,” emitting harmful pollution into the neighborhoods surrounding the factory.

While Tesla has been praised for the environmental benefits of driving electric vehicles, its manufacturing practices have come under fire from environmentalists. The company was ranked at number 89 on the 2023 Toxic 100 Air Polluters list, compiled by the Political Economy Research Institute at the University of Massachusetts at Amherst. In 2022, the Environmental Protection Agency fined Tesla $275,000 for failing to measure, track, and record its emissions or to minimize air pollutants from painting operations at the facility.

Tesla has faced previous legal challenges related to environmental issues. Earlier this year, the company settled with 25 counties in California over its handling of hazardous waste materials at facilities throughout the state. In Germany, environmentalists have protested Tesla’s forest clearing to build a factory outside Berlin, as well as the company’s water consumption practices.

The recent lawsuit in California described Tesla’s environmental violations as “ongoing,” with residents and employees in the surrounding area being exposed to harmful air pollution. The pollutants identified include nitrogen oxides, arsenic, cadmium, and other harmful chemicals. The Bay Area Air Quality Management District, an environmental regulator, has accused Tesla of allowing “unabated emissions” in Fremont that should have been prevented. The agency has issued 112 violation notices to Tesla since 2019 and is seeking an abatement order to force the company to make changes to its factory operations.

Regulators have highlighted issues with equipment breakdowns at the Tesla assembly plant, leading to emissions being released directly into the air without proper filtration. There have also been allegations that Tesla employees or contractors have disabled air pollution controls in the factory, especially during paint shop equipment malfunctions. The painting process for vehicle bodies is a critical operation at the factory, and Tesla has a history of repeated fires in this area.

Elon Musk, the CEO of Tesla, has previously emphasized the company’s focus on innovation, particularly in autonomous driving technology. However, Musk has also courted controversy with comments about climate activists, referring to them as “communists” and sharing derisive memes targeting them on social media platforms like Twitter. Tesla has not yet responded to the recent allegations made by the Environmental Democracy Project.
